Madonna Lawsuit Over Late Tour Start Dismissed Permanently, No Chance for Refiling

The lawsuit against Madonna about the late start of her Celebration World Tour has been dropped for good, and it can’t be brought back to court. Filed by plaintiffs Michael Fellows and Jason Alvarez, the lawsuit alleged that Madonna’s December 13 show in Brooklyn began much later than advertised, leading to claims of false advertising and deceptive trade practices.

Madonna, represented by attorney Jeff Warshafsky, clarified in a letter dated June 19 that the dismissal was not the result of a settlement between the parties. The letter indicated that Madonna and Live Nation disagreed with the plaintiffs’ suggestion that each party should bear its own legal costs.

Warshafsky characterized the lawsuit as a strategic attempt to pressure them into a settlement, noting that the defendants viewed the legal action as frivolous and intended to contest it.

Furthermore, the defendants reserved the right to pursue sanctions, attorneys’ fees, and other costs related to what they described as a baseless lawsuit. The plaintiffs had previously filed a notice of settlement, which was subsequently struck down by the court, adding complexity to the legal proceedings.

The lawsuit originally argued that the delayed start time of the concert led to increased costs and inconvenience for attendees, who were unprepared for the late-night schedule. It claimed that had they known about the timing beforehand, they would not have purchased tickets.

Separately, another fan named Justen Lipeles filed a similar lawsuit on May 30, alleging that Madonna and Live Nation misled ticket buyers regarding the start times of her California shows and other aspects of the concert experience. These allegations include claims of uncomfortable temperatures and objectionable stage performances.

While the specific lawsuit by Fellows and Alvarez has been dismissed, legal disputes surrounding Madonna’s tour performances continue to unfold, highlighting ongoing disagreements over concert logistics and audience expectations.
